Spotifybooster.com specializes in supporting the social media presence of companies and private individuals. The objective is to increase the popularity of this presence, focusing on common social media platforms. There is expressly no affiliation or business relationship with the social networks themselves.
Spotifybooster.com acts strictly as an intermediary service provider. Through the services mediated by Spotifybooster.com, it is possible to achieve a one-off, rapid, or continuous increase in reach on social media platforms. Since Spotifybooster.com acts solely as an intermediary and entrusts third parties with the task of increasing reach, Spotifybooster.com cannot guarantee 100% of the user growth goal aimed for by the buyer. However, in almost every case, the goal is achieved and often exceeded. If the goal is not fully achieved, Spotifybooster.com will reimburse the payment made by the customer (proportionately, if necessary). Reimbursement for percentage deviation is not permitted if the goal has been achieved but a portion is subsequently lost.
1. Definitions
1.1) These General Terms and Conditions apply exclusively to the business relationship between the provider "Spotifybooster.com" ("Provider") and the customer in the version valid at the time of the order. Deviating terms and conditions of the customer are not recognized unless the Provider expressly agrees to their validity in writing.
1.2) The customer is considered a Consumer insofar as the purpose of the goods and services ordered cannot be attributed primarily to their commercial or independent professional activity. In other cases, customers are considered Entrepreneurs (any natural or legal person or legal partnership exercising their commercial or independent professional activity when concluding the contract).
2. Object of Service
2.1) Spotifybooster.com provides services for social media platforms including, but not limited to, Facebook, Instagram, Soundcloud, Spotify, Twitter, Twitch, TikTok, and YouTube.
2.2) The object of performance is the provision of services to increase reach (followers, likes, comments, views, retweets, shares, etc.). Services enable a one-time and rapid increase in reach for both individuals and companies.
2.3) The provision of services is considered fulfilled if at least the agreed number of followers, likes, or comparable goals has been achieved.
2.4) While the Provider assures the customer will receive at least the ordered number of goals, the exact number cannot be guaranteed; typically, the agreed number is slightly exceeded. For playlist pitching, if the guaranteed number of streams is not reached during the runtime, the song will remain in the playlist until the guarantee is met.
2.5) Proof of delivery is recorded using third-party meter readings or screenshots. Natural organic growth or measures purchased through other providers cannot be taken into account. The Provider has no influence on side effects such as comments or personal messages resulting from the service.
2.6) Refill Policy: Declines in followers/engagement may occur. To compensate, Spotifybooster.com typically over-delivers by approx. 10% in advance. If a decline occurs such that the ordered quantity is no longer visible, Spotifybooster.com will replenish the decline within statutory deadlines, unless the specific product description explicitly excludes refills.
2.7) Once the service (followers, likes, views, etc.) has commenced, cancellation is not possible. A claim to cancel previous services is excluded. Due to the nature of the service, delivered engagement cannot be removed or undone.
2.8) Profile Origins: Mediated engagement comes from international profiles unless otherwise stated. These do not represent a global average; in extreme cases, they may originate heavily from a single region. Inactive users may be present. The customer has no claim to specific criteria regarding the origin of followers/likes unless expressly agreed upon or stated in the offer.
2.9) The Provider reserves the right to refuse service for content including:
Illegal content violating criminal law, data protection, or copyright
Political, religious, discriminatory, defamatory, or anti-constitutional content
Content glorifying violence
3. Conditions for Provision of Service
3.1) The customer must transmit the correct URL/username and adjust privacy settings (e.g., public profile, no age/country restrictions) to allow service delivery.
3.2) Custom packages may be purchased if agreed upon in writing (email or messenger) prior to purchase.
3.3) Monetization Warning: If monetized advertising is active on a video/account, it is recommended to deactivate it during service processing to avoid issues with AdSense or advertising accounts. Spotifybooster.com assumes no responsibility for issues arising from this.
3.4) Parallel orders with other providers should be avoided to prevent delivery conflicts.
3.5) While the Provider strives for high quality, there is no guarantee that 100% of profiles will have profile pictures or descriptions. Additionally, comments ordered in a specific language (e.g., German, English) may come from international profiles; only the text language is guaranteed.
3.6) The Provider is not responsible for incorrect links or profile settings provided by the customer.
3.7) All services originate from real users, though no guarantee is given regarding the activity level of these users.
4. Order Process and Conclusion of Contract
4.1) Product presentations in the online shop are invitations to place an order, not legally binding offers.
4.2) The customer selects products and places them in the shopping cart. By clicking "Buy now," the customer submits a binding application to purchase and agrees to these Terms and Conditions.
4.3) Accurate data provision is required. All data is treated with strict confidentiality.
4.4) The contract is a Service Contract, not a sales contract, as the Provider mediates the services.
4.5) An automatic email confirms receipt of the order but does not constitute acceptance. The order is valid upon payment confirmation. Service typically begins within 24 hours, but may take up to three working days.
5. Assurance of Increased Reach
5.1) Services are brokered; profiles are not sold.
5.2) Specific reach growth numbers are agreed upon as the subject of the order. If the goal is not met, the customer receives a refund proportionate to the deviation. Refunds are not permitted if the goal was achieved but subsequently lost.
5.3) Delivery time overruns or over-delivery are not grounds for defect claims. However, if delivery time is exceeded and the goal is not met, a partial refund applies.
5.4) Cancellation requests may not be fulfilled if the delivery process has already started (which can happen minutes after the order).
5.5) Platform Updates: A decrease in reach due to "clean-up" updates by platforms (e.g., Instagram deleting inactive accounts) cannot be predicted or avoided. Spotifybooster.com cannot replace, replenish, or refund orders affected by such platform-side actions.
6. Acceptance of Service
6.1) The customer is obliged to accept the service if it meets order specifications. Acceptance must be declared in text form.
6.2) Partial acceptance of service components is required if they meet contractual requirements.
6.3) Proof of performance is based on meter readings or screenshots. Complaints cannot be considered after campaigns constitute completion if evidence shows service was provided. No reimbursement is made for force majeure if delivery occurred prior to the difficulty.
6.4) Performed services cannot be reversed.
7. Obligations of the Customer
7.1) The customer must provide necessary cooperation (correct URL, public settings, etc.).
7.2) If cooperation is delayed, the Provider may perform services at its discretion after a deadline or withdraw from the contract. The customer is liable for damages caused by a breach of cooperation duties.
7.3) The Provider retains the claim for payment even if service cannot be provided due to a lack of customer cooperation.
7.4) The customer is solely responsible for content and indemnifies Spotifybooster.com against third-party claims.
7.5) Customers may only use services for profiles they own or are authorized to manage.
7.6) The customer assures their profiles do not violate applicable laws or third-party rights. The Provider does not perform legal reviews of content.
8. Liability
8.1) Claims for damages are excluded, except for injury to life, limb, health, or essential contractual obligations (cardinal obligations) caused by intent or gross negligence.
8.2) Liability for breach of essential obligations is limited to foreseeable damage typical of the contract.
8.3) Platform Actions: Spotifybooster.com assumes no liability if social media platforms delete, block, or penalize customer profiles. Negative effects on search engine placement or other side effects are the sole risk of the customer.
9. Legal Responsibility
9.1) The customer is responsible for ensuring the use of Spotifybooster.com services complies with applicable laws and platform terms.
9.2) Services must be used in compliance with legal regulations.
9.3) The Provider is not liable for the legality of the service usage regarding the customer’s specific social media presence.
9.4) The customer indemnifies Spotifybooster.com against all third-party claims and legal costs associated with the provision of services.
10. Guarantee
10.1) No liability is accepted for restoring profile conditions existing prior to the service.
10.2) No guarantee is given for position improvements (ranking).
10.3) Long-term retention of followers/likes is not guaranteed.
10.4) In the event of under-delivery, the Provider will deliver the difference immediately upon notification.
10.5) If mediation fails entirely (service does not start), the customer receives a full refund. This does not apply if the failure is the customer's fault.
11. Payment
The following payment methods are generally available:
Credit Card: Charged automatically upon legitimation.
PayPal / PayPal Express: Payment transaction carried out automatically by PayPal.
Sofort (by Klarna): Direct bank transfer via online banking.
Apple Pay: Transaction confirmed via Apple service provider.
Google Pay: Transaction confirmed via Google service provider.
Purchase on Account (Klarna): Available to consumers. Payment period is 14 days.
12. Dispute Resolution
The European Commission provides a platform for online dispute resolution. The Provider is generally not willing or obliged to participate in dispute settlement procedures before a consumer arbitration board.
13. Final Provisions
13.1) Applicable laws govern contracts between Spotifybooster.com and the customer, excluding UN sales law.
13.2) If the customer is a merchant, legal entity under public law, or special fund under public law, the place of jurisdiction for all disputes is the Provider's headquarters in Panama.
13.3) The order language is English.
13.4) In the event of discrepancies between different language versions of these Terms, the English version takes precedence.
